How long does it take to short sale a home? - Antioch CA Homes for ...

Question: ?How long does it take to short sale a home? ?

Answer: ? ?Although it is?difficult?to determine the timeline of a?short sale?as you may not be fully aware of who the Investors are that make the?decisions,? is it a?Fannie Mae loan, or?Freddie?Mac loan, is there a mortgage insurance involved, and do you qualify for HAFA , etc? ?There are three very real phases every short sale goes through. ? ?Knowing these phases will help you to know where you are in the process and can give you an idea of when you may?receive?the highly anticipated approval. ??The three phases a short sale goes through are Submission, Valuation, ?and Approval.

Phase ?1 of 3: ? Submission

The Submission phase is when all?documents are submitted?to the lender for review and a?Negotiator (this will be your main contact) is assigned. ?In order to process the short sale and validate the Sellers Hardship the Seller will need to provide the following documents. Before preparing these documents you may want to check if you are?eligible?for a HAFA short sale.

List of documents that may be needed

  • Hardship Letter
  • Financial Statements
  • HAFA Forms
  • Lender Specific Forms
  • Bank Statements
  • Tax returns
  • Pay Stubs
  • Pnl (if self employed)
  • SalesContract
  • Listing Agreement
  • HUD1 (itemized list from a Title Company detailing cost associated with the sale and the Lien Holders net proceeds)

Phase 2 of 3: ? Value

Lien Holders (especially the first Lien Holder involved in the short sale) will want to know the value of the property prior to approving the short sale. ?Lien Holders do not want to sell the property below market value. ?They will more likely approve a sale if the value of the sales contract and the Lien Holders?opinion?of value are similar. ?In my experience, banks will generally approve an offer if it is within 93%-100% of their?opinion?of the value. ? ?Check the value of your home.

The Lien Holders will likely complete any or perhaps all of the below to determine value:

  • Appraisal (Completed by a Licensed?Appraiser?however not the same appraisal you would use for financing the property)
  • B.P.O. (Broker Price?Opinion?often completed by a local Real Estate Agent)
  • A.V.M. (Automated?Valuation?Model an online?opinion?of value)

Phase 3 of 3: ? Approval

Your almost there? ? This is the phase where the Servicer obtains approval from their Investors. ? The Listing Agent (Sellers Agent) may also need to obtain an approval from other Lien Holders (Tax Lien Holders, 2nd mortgages, 3rd mortgage, private liens, etc?) ? Once all?Lien Holders?approve an approval letter is issued usually from each?Lien holder?providing approval.

A word of advise. ?Read the letters carefully, they may have changed some of the terms in the?original?offer and because it may have been months since it was written you may have forgotten some of the terms.

The real name for a short sale is short pay as one or maybe all of the lenders involved?end up short of the amount owed upon the sale of the home. ? It is rarely a quick sale as it can?often take months to short sale a home however follow the three phases outlined above and you?will have a better understanding of the timeline of a short sale. ? Considering a divorce? Wait until January

8 hrs.

Going through a divorce during the holidays can be emotionally wrenching, which is why many people don't do it -- they put it off until January.?

"People don't want to upset the apple cart over the holidays, and they want a peaceful Christmas, Hanukkah or New Year's. And then, because they don't want to spend another damned year with that spouse of theirs, as soon as the holidays are over they pull the plug and file," says Alton Abramowitz, president of the American Academy of Matrimonial Lawyers.?

While there are no hard numbers on how many divorces are filed in January, Abramowitz says it's undoubtedly a popular time to act, rivaled only by September, when marriages break up after the summer holidays. Yet waiting for the holidays to pass doesn't all come down to simply wanting a harmonious holiday season. There are sound financial reasons to wait until January.?

1. Waiting for the bonus?
A husband or wife who waits until January is likely to be entitled to any year-end windfall that might come from a spouse's job.?

"In New York, at least, once you file for divorce and you set the cut-off date; anything you obtain afterward is separate property," says Steven Goldfeder, a matrimonial attorney in New York City who acknowledges that year-end bonuses are often fought over, even if a spouse declares he or she wants a divorce in January. "Someone could claim the bonus isn't really for that particular year, but a payment to entice someone to stay at the firm for the future."?

2. Cool your emotions?
The holidays are a time when emotions run high. "If your spouse always has it in her mind that Christmas was ruined, she or he may not be so eager to settle with you," says Goldfeder. "Your divorce might drag out for months or years longer than it would have."?

Once, shortly before Christmas, Goldfeder received a call from a client who said a co-worker had had a baby they both believed was his. The client, married and the father of three, planned to tell his wife and assumed she would leave him. Goldfeder talked him into first getting a paternity test. The client's family had a nice Christmas, and the day after, the client learned he wasn't the father.?

Not exactly a warm holiday tale, but by cooling your emotions, you may save your family a lot of stress.?

3. Avoid disastrous shopping?
December is the shopping season, and that can spell disaster if an angry spouse is set loose with a credit card. "The spouse served with divorce papers may feel that they deserve some kind of emotional gift because of this horrible thing their spouse did to them," says Kevin Worthley, a certified divorce financial analyst and certified financial planner in Warwick, R.I.

An angry spouse may also be more inclined to want to drain the bank accounts and run up the credit cards. "That's a danger any time, but past the holidays, when everything's been bought, there's likely less inclination to buy a big-ticket item out of revenge," says Worthley.?

4. Think about April?
At year-end, taxes come to mind. "Obviously, the better records you have, the better position you're going to be in," says Andrew Katzenstein, a Los Angeles lawyer, referring to paperwork that you might want to start collecting now.?

Katzenstein, who specializes in assisting high-net-worth individuals, businesses and charities, says that in the past there haven't been many tax advantages to filing for a divorce in January rather than December. Filling for divorce is just a beginning step, after all. Many couples end up filing their taxes jointly until the divorce is completed.?

But tax brackets may go up in 2013, depending on whether the U.S. budget dispute is resolved. So going forward, the calculus may be different. "The person who pays alimony will get more bang for their deduction buck, and the person receiving the payments will pay more taxes," he says.?

5. More time to plan?
If you've made up your mind that a divorce is going to be one of your New Year's resolutions, there are things you can do now. Whatever side you end up on -- paying alimony or receiving it -- you need to start preparing.?

"You should start collecting all of your end-of-the-year statements," says Worthley. "You really need to know everything -- your household budget, your assets, what's in your checking account, how much you're paying for the mortgage, all of your debts and your credit card balances. It's important to get all of that."?

Your financial records will be needed to determine how much spousal support will be paid out, and how the finances will be divided. "The more information you get, the less complicated it'll be when you're negotiating and working things out with a financial mediator, attorney or judge," says Deborah Moskovitch, a divorce coach in Toronto who counts January as her busiest month for new clients.?

The turn of the new year can also be a good time to try to salt away some extra money to pay for an attorney, says Worthley.?

You don't need to have all of your money affairs in order the moment you and your spouse begin discussing the dreaded D-word. You may want to start the year off with a fresh start by filing for divorce in January, but chances are you'll be lucky to be divorced before that year is up.?

"Here in California, if you didn't file by October, you weren't going to get divorced in the next year anyway," says Katzenstein. "And if you decide to divorce in January, it's not like you'll be divorced in February. It's going to be a process."?

(AP) ? Pope Benedict XVI wished Christmas peace to the world Tuesday, decrying the slaughter of the "defenseless" in Syria, urging Israelis and Palestinians to find the courage to negotiate and encouraging China's new leaders to allow more religious freedom.

Delivering the Vatican's traditional Christmas day message from the central balcony of St. Peter's Basilica, Benedict also encouraged Arab spring nations, especially Egypt, to build just and respectful societies.

May China's new leadership "esteem the contribution of the religions, in respect for each other" to help build a "fraternal society for the benefit of that noble people," the pope prayed.

It was a clear reference to the Chinese government's often harsh treatment of Catholics loyal to the pontiff instead of to the state-sanctioned church. Earlier this month, the Vatican refused to accept the decision by Chinese authorities to revoke the title of a Shanghai bishop, who had been appointed in a rare show of consensus between the Holy See and China.

As the 85-year-old pontiff, bundled up in an ermine-trimmed red cape, gingerly stepped foot on the balcony, the pilgrims, tourists and Romans below backing St. Peter's Square erupted in cheers.

Less than 12 hours earlier, Benedict had led a two-hour long Christmas Eve ceremony in the basilica. He sounded hoarse and looked weary as he read his Christmas message and then holiday greetings in 65 languages.

In his "Urbi et Orbi" speech, which traditionally reviews world events and global challenges, Benedict prayed that "peace spring up for the people of Syria, deeply wounded and divided by a conflict that does not spare even the defenseless and reaps innocent victims."

He called for easier access to help refugees and for "dialogue in the pursuit of a political solution to the conflict."

Benedict prayed that God "grant Israelis and Palestinians courage to end long years of conflict and division, and to embark resolutely on the path to negotiation."

Israel, backed by the United States, opposed the Palestinian statehood bid, saying it was a ploy to bypass negotiations, something the Palestinians deny. Talks stalled four years ago.

Senior Palestinian official Saeb Erekat said that in a meeting with the pope last week, Palestinian President Mahmoud Abbas "emphasized our total readiness to resume negotiations." The Palestinians have not dropped their demand that Israel first stop settlement activities before returning to the negotiating table.

Hours earlier, in the ancient Bethlehem church built over the site where tradition holds Jesus was born, candles illuminated the sacred site and the joyous sound of prayer filled its overflowing halls.

Overcast skies and a cold wind in the Holy Land didn't dampen the spirits of worshippers in the biblical West Bank town. Bells pealed and long lines formed inside the fourth-century Church of the Nativity complex as Christian faithful waited to see the grotto that is Jesus' traditional birthplace.

Duncan Hardock, 24, a writer from MacLean, Va., traveled to Bethlehem from the republic of Georgia, where he had been teaching English. After passing through the separation barrier Israel built to ward off West Bank attackers, he walked to Bethlehem's Manger Square where the church stands.

"I feel we got to see both sides of Bethlehem in a really short period of time," Hardock said. "On our walk from the wall, we got to see the lonesome, closed side of Bethlehem ... But the moment we got into town, we're suddenly in the middle of the party."

Bethlehem lies 10 kilometers (6 miles) south of Jerusalem. Entry to the city is controlled by Israel, which occupied the West Bank in 1967.

For those who couldn't fit into the cavernous Bethlehem church, a loudspeaker outside broadcast the Christmas day service to hundreds of faithful in the square.

Their Palestinian hosts, who welcome this holiday as the high point of their city's year, were especially joyous this season, proud of the United Nations' recognition of an independent state of Palestine just last month.

"From this holy place, I invite politicians and men of good will to work with determination for peace and reconciliation that encompasses Palestine and Israel in the midst of all the suffering in the Middle East," said the top Roman Catholic cleric in the Holy Land, Latin Patriarch Fouad Twal in his annual address.

Back at the Vatican, Benedict offered encouragement to countries after the Arab spring of democracy protests. He had a special word for Egypt, "blessed by the childhood of Jesus."

Without citing the tumultuous politics and clashes in the region, he urged the North African region to build societies "founded on justice and respect for the dignity of every person."

Benedict prayed for the return of peace in Mali and harmony in Nigeria, where, he recalled "savage acts of terrorism continue to reap victims, particularly among Christians."

The Vatican for decades has been worried about the well-being of its flock in China, who are loyal to the pope in defiance of the communist's government support of an officially sponsored church, and relations between Beijing and the Holy See are often tense.

Speaking about China's newly installed regime leaders, Benedict expressed hope that "they will esteem the contribution of the religions, in respect for each other, in such a way that they can help to build a fraternal society for the benefit of that noble people and of the whole world."

Acknowledging Latin America's predominant Christian population, he urged government leaders to carry out commitments to development and to fighting organized crime.

In Britain, the royal family was attending Christmas Day church services at St. Mary Magdelene Church on Queen Elizabeth II's sprawling Sandringham estate, though there were a few notable absences. Prince William is spending the holiday with his pregnant wife Kate and his in-laws in the southern England village of Bucklebury, while Prince Harry is serving with British troops in Afghanistan.

Later Tuesday, the queen delivered her traditional, prerecorded Christmas message, which for the first time was broadcast in 3D.

At Canterbury cathedral, Anglican leader Rowan Williams delivered his final Christmas day sermon as archbishop of Canterbury. He acknowledged how the church's General Synod's vote against allowing women to become bishops had cost credibility and said the faithful felt a "real sense of loss" over the decision.

These small goals pave the way to a lifetime success.

You can dream to reach the sun or set it as a goal, but this is not possible in reality. Therefore, only dream of the goal that is possible to attain. Then, break down your achievement goal into small action goals to shoot for the stars.

PFT: John Fox makes case for Peyton as NFL MVP

RexandTebowReuters

The day after multiple reports emerged that Jets quarterback Tim Tebow tapped out of the Wildcat package because he wasn?t picked to be the starter in Week 16, the effort continues to put the toothpaste back in the tube.

On Sunday, Tebow was asked why he didn?t appear in the alternative offense, which instead saw receiver Jeremy Kerley taking snaps.? ?It just kind of happens,? Tebow said.

On Monday, after multiple sources said that Tebow had specifically asked for it to happen after he was told he wouldn?t be starting, Tebow didn?t address the question of whether he had asked to be left out of the Wildcat package in an interview with ESPN?s Adam Schefter.

Now, coach Rex Ryan has tackled the topic while evading the one key piece of information in which everyone is interested.? According to Manish Mehta of the New York Daily News, Ryan chose not to share the details of his communications with Tebow.

And all that that implies.

?I?ve been transparent and all that stuff without question, but I?m not going to give you a private conversation that I would have with a player,? Ryan said in a conference call with reporters.? ?That?s between him and I.? If he wants to share whatever the conversation is ? Tim or anybody else ? that?s up to him.?

Ryan is treading on delicate ground, given that he and Tebow are both represented by the same agent, CAA?s Jimmy Sexton.? As a result, Ryan will say nothing publicly that damages Tebow?s carefully-cultivated team-first-team-only-thank-you-sir-may-I-have-another fa?ade.

?If I would have asked Tim to play in anything,? Ryan said.? ?Tim would have gone into the game and done that.?

Right.? If Ryan would have asked.? But that overlooks the question of whether Tebow had asked Ryan not to ask.

While some have suggested (including Peter King, in the video appearing below) that Tebow?s position was understandable given the manner in which he has been jerked around by the Jets, Tebow has tried for years to make us think that he?s the kind of guy who never would make such a request due to frustration regarding his role.? And for the Tebow skeptics out there who believe that much of who he is and what he is has been carefully orchestrated and manipulated, Sunday?s reports reflect the most significant and tangible proof that there?s a man behind the curtain who is far more flawed and far more human than the image that Tebow?s camp has been selling.

At this point, Tebow?s best move would be to admit it.

Revealed: Rudolph Really Did Have a Red Nose

Most people know Rudolph the Red-Nosed Reindeer had a very shiny nose ? but why? Medical researchers say they've now found the answer.

The secret to Rudolph's rosy schnozzle is the dense network of blood vessels in his nose.?Reindeer, it seems, have 25 percent more capillaries carrying red, oxygen-rich blood in their nasal architecture than humans, say the scientists from the Erasmus Medical Center in Rotterdam, the Netherlands, and the University of Rochester in New York.?

"In colder climates and also when they are higher up in the atmosphere pulling Santa's sleigh, the increase in blood flow in the nose will help keep the [nose's] surface warm," Dr. John Cullen of the University of Rochester told MedPage Today. The dense network of blood vessels in reindeer noses is also essential for regulating the animal's internal body temperature ? like many mammals, reindeer don't sweat.

The researchers took advantage of high-tech instruments like hand-held intravital video microscopes to compare the blood vessels of two reindeer (Rangifer tarandus) with those of human volunteers (five healthy humans and one with nasal polyps). One of the human volunteers was examined after inhaling 0.0035 ounces (100 milligrams) of cocaine, "a drug routinely used in ear, nose, and throat medicine as a local anaesthetic and vasoconstrictor," the researchers write in the British Medical Journal this week.

"We're kind of glad they didn't do the same thing with the reindeer, because the last thing we would want is reindeer on cocaine, pulling Santa around the sky," said Cullen.

Their results showed reindeer noses do turn a rosy red; after a treadmill test, the reindeer's nose showed up as red (warm) in a thermographic image. In addition, they found glandlike structures in the nasal mucous membrane of reindeer and humans; the structures were surrounded by capillaries, and the researchers suspect, at least in humans, they secrete mucus.

"These results highlight the intrinsic physiological properties of Rudolph's legendary luminous red nose, which help to protect it from freezing during sleigh rides and to regulate the temperature of the reindeer's brain, factors essential for flying reindeer pulling Santa Claus' sleigh under extreme temperatures," they write.
